Subscription Terms

1. Scope

1.1 These Subscription Terms apply to all paid subscriptions for the SteerMind AI service concluded via the Google Play Store.

(hereinafter "SteerMind" or "Provider")

1.3 These Subscription Terms supplement the Terms of Use, the Privacy Policy, and the product information in the Google Play Store. In the event of a conflict between these Subscription Terms and the Terms of Use, the Subscription Terms shall prevail with respect to subscription-specific provisions.

2. Service Description

2.1 SteerMind AI is an AI-assisted service for plant cultivation, in particular cannabis cultivation in controlled environments.

2.2 Depending on the selected subscription plan, the service may include the following features:

2.3 The subscription constitutes a contract for the provision of digital services within the meaning of Sections 327 et seq. of the German Civil Code (BGB).

3. Contract Conclusion and Processing via Google Play

3.1 Paid subscriptions are concluded exclusively via the Google Play Store. The contract is formed upon confirmation of the purchase in the Google Play Store.

3.2 The Google Play Terms of Service apply additionally. Payment processing is handled by Google LLC. Payment data (e.g. credit card details) is not transmitted to SteerMind and is not stored on our servers.

3.3 Subscription features are activated after successful booking and verification of the purchase token by our systems.

4. Pricing and Subscription Plans

4.1 The available subscription plans, billing periods, any trial periods, and the respective prices are displayed in the Google Play Store before purchase.

4.2 All stated prices are gross prices including the applicable statutory value-added tax.

4.3 The information displayed in the Google Play Store at the time of purchase is decisive.

5. Term, Renewal and Plan Switching

5.1 Subscriptions renew automatically for the selected billing period unless cancelled in time.

5.2 Cancellation is possible at any time with one month's notice to the end of the current billing period via the Google Play Store.

5.3 Where technically supported, users may switch to a different subscription plan within the app or via the Google Play Store. The terms of the plan switch are governed by Google Play's policies.

6. Cancellation

6.1 Subscription cancellation is handled via the Google Play Store:

  1. Open the Google Play app on your Android device.
  2. Navigate to Account → Payments & subscriptions → Subscriptions.
  3. Select SteerMind AI and cancel the subscription.

6.2 Where SteerMind provides its own cancellation functions within the service, these may also be used to cancel (Section 312k BGB).

6.3 Deleting the app from your device does not cancel the subscription.

6.4 After effective cancellation, access to subscription features remains active until the end of the already paid billing period.

7. Right of Withdrawal for Consumers

7.1 Withdrawal Instructions

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

You may also declare the withdrawal via the Google Play refund process.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this reimbursement, we shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees as a result of such reimbursement.

If you requested that the services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you inform us of the exercise of the right of withdrawal with regard to this contract, compared to the total scope of the services provided for in the contract.

8. Refunds

8.1 Refunds for subscriptions concluded via Google Play are processed through Google Play's refund mechanisms.

8.2 If you have questions or issues with a purchase, you may also contact us directly at contact@steer-mind.com.

9. Availability, Maintenance and Third-Party Dependencies

9.1 SteerMind endeavours to provide high availability of the service on a best-effort basis. Uninterrupted availability cannot be guaranteed.

9.2 Maintenance, security updates, and technically necessary downtime may temporarily limit availability.

9.3 The service uses external AI services (including the Google Gemini API), databases, and other third-party services. Service quality may therefore also depend on the availability and performance of those third-party providers.

10. Updates and Changes to the Service

10.1 SteerMind provides updates to the service in accordance with Section 327f BGB, insofar as this is necessary to maintain the conformity of the digital service with the contract.

10.2 SteerMind may change the service beyond what is necessary to maintain conformity, provided there is a valid reason for doing so (Section 327r BGB). A valid reason exists in particular where the change is necessary to adapt the service to a new technical environment or to an increased number of users, or where this is required for other significant operational reasons.

10.3 Users will be notified in a timely manner of material changes affecting the contractually agreed scope of features.

11. Usage Rules

11.1 Use of SteerMind AI is permitted exclusively for lawful purposes. Cannabis-related content may only be accessed in jurisdictions where cultivation is legally permitted.

11.2 Use is restricted to persons aged 18 and over.

11.3 The following conduct is prohibited:

11.4 In the event of violations of these usage rules, SteerMind may temporarily or permanently suspend access to the service without any entitlement to a refund. The right to extraordinary termination remains unaffected.

12. Information on AI-Generated Content

12.1 When using SteerMind AI, you interact with an AI system. Responses are machine-generated.

12.2 The information provided serves as general support and does not constitute professional agronomic, legal, or medical advice.

12.3 The user is solely responsible for independently evaluating the information and recommendations received and for seeking professional advice where appropriate.

13. Rights in Case of Defects

13.1 The statutory provisions of Sections 327 et seq. BGB apply to rights in case of defects of the digital service.

13.2 In the event of a defect, SteerMind has the right and obligation to provide cure (rectification) first.

14. Liability

14.1 SteerMind is liable without limitation

14.2 In cases of slight negligence in the breach of material contractual obligations (cardinal obligations), SteerMind's liability is limited to the typical foreseeable damage.

14.3 Liability is otherwise excluded.

14.4 The above limitations of liability do not apply where SteerMind has fraudulently concealed a defect or has assumed a guarantee for the quality of the service.

15. Dispute Resolution

SteerMind is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.

16. Changes to These Subscription Terms

16.1 SteerMind reserves the right to amend these Subscription Terms for objectively justified reasons, in particular in the event of changes in the legal framework, case law, or technical conditions.

16.2 Users will be notified of material changes in a timely manner.

16.3 The statutory rights of consumers remain unaffected by changes to these Subscription Terms.

17. Applicable Law

17.1 The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

17.2 Consumers who are habitually resident in a member state of the European Union shall have the benefit of the mandatory consumer protection provisions of their state of residence, insofar as these are more favourable to the consumer.
